Who decides if it’s bribery or business?

MY WEBSTER’S dictionary defines bribery as the act or practice of giving or taking a bribe. A bribe is money or favor given or promised to a person in a position of trust to influence his or her judgment or conduct.

Now begins the job of interpretation. Can any bribe be considered legal?

Are bribes, by any measure, illegal and a pox on any system or transaction? It may be hard to think of a situation where offering a bribe would be looked at in a favorable light.
In the last two weeks there were two national stories that gained major headlines.
